- OBJECT
1.1. The purpose of these Terms and Conditions of purchase is the supply by MOOISH of the products offered in its Online Store, in exchange for a financial consideration.

2.1. These Terms and Conditions, together with your order confirmation, constitute the contract between MOOISH and the Customer for the supply of products. No other Terms and Conditions shall apply.

- PLACING AN ORDER
3.1. The Customer must complete the entire purchasing process and make the payment using any of the systems provided on the website.
3.2. When the Customer places an order, we will send them an order number.
3.3. By placing an order, the Customer is making an offer to purchase the products they have selected in accordance with these Terms and Conditions. MOOISH may accept or reject their offer.
3.4. If we accept their order, we will notify the customer of our acceptance by issuing an order confirmation. If we are unable to accept their order, we will contact the Customer to inform them through any of the contact methods they have provided in their order.

While we will make every effort to supply the products listed in their order confirmation, there may be occasions where we are unable to supply such products, for example, if the products are out of stock. In such cases, we will contact the Customer to inform them and may suggest alternative products they may wish to purchase. If they do not accept our suggestions, we will cancel their order for the products we are unable to supply and refund any amount they have paid for such products. The refund of these amounts will be the extent of our liability to the Customer in the event that we are unable to supply the requested products. Occasionally, the prices of products displayed on our Online Stores may be incorrectly specified and show a lower price than intended due to an error. When this happens and if we have confirmed their order, we will immediately contact them to issue a new order confirmation with the correct price. In the event that the correct price is significantly higher, the Customer may cancel their order and we will refund any amount they have already paid.

We pay great attention to the information regarding the essential characteristics of the products through technical descriptions provided by collaborating companies and manufacturers, as well as photographs illustrating the products. - PRICES
6.1. The price of each product will be clearly determined on the website. The price and conditions of the products offered may vary, but in any case, the price and conditions that were in effect when the order was placed will always apply to the Customer.
6.2. We reserve the right to charge the order from the moment of its receipt.
6.3. The sale prices indicated on our Online Store are displayed as follows:
If the customer lives in Spain, all prices include VAT.
6.4. Shipping service fees are not included in the price of the products. Shipping service fees are the responsibility of the Customer and will be added to the total amount of the selected products. You will be informed of these fees before confirming the order and finalizing the contracting process.
6.5. We reserve the right to modify our prices at any time. However, we commit to apply the current rates indicated on the website at the time of placing the order by the Customer.
- AVAILABILITY
7.1. It should be noted that orders will be shipped within the limits of available stock. If one of the ordered items is not in stock, we commit to contact the Customer as soon as possible (from the date the order was placed) to inform them of the timeframe in which we can send their product(s). If the Customer is not interested in waiting, they may request a refund of the amounts paid for that item.
7.2. If any of the products in your order, once invoiced, is not available, we commit to send the Customer the available products and to waive the shipping service fees for the rest of their purchase. If possible, we will propose an equivalent quality and price item as a replacement for the unavailable product. If the Customer does not accept the proposed substitute product, we will proceed with the refund of the unavailable product.
- PAYMENT FOR PRODUCTS
8.1. If our security department suspects any anomaly or fraud, MOOISH reserves the right to cancel the transaction for security reasons.
8.2. MOOISH offers the Customer payment options with card, paypal , and bizum . For security reasons, MOOISH verifies all orders paid with a bank card. We accept American Express cards, any Visa, and MasterCard registered in the secure payment system Verified by Visa.
8.3. In case the purchase is made by an end consumer or a company, the corresponding invoice will be issued. Both will include the breakdown of the Value Added Tax if applicable and the shipping costs.
- DELIVERY OF PRODUCTS
9.1. We will send the Customer their products to the delivery address provided in their personal data form.
9.2. On the website, specifically in the shopping cart, the shipping costs are indicated before making the purchase.
9.3. If the item is marked as “in stock” when placing the order, the time between placing the order and the delivery date will be 24/72 business hours from our validation of the received payment. If the item is not in stock at the time of placing the order, we will contact the Customer to inform them accordingly. The estimated delivery times are for orders placed in the mainland and may vary if they are placed from the Balearic Islands.
9.4. We will deliver the product once it has been verified that the payment has been successfully processed.
9.5. We consider hours and days as business hours and days, excluding Saturdays, Sundays, and holidays. If, due to any reason attributable to MOOISH, this deadline is exceeded, we will inform the Customer of the incident and propose alternative solutions.
9.6. The Customer agrees that either they or a designated person will be present at the specified address to receive the package. If they are not available the first time, the carrier will make several attempts. If the order still cannot be delivered, it will be deposited at the nearest branch of the shipping company handling the package. If the package cannot ultimately be delivered and is returned, the Customer will be refunded the payment made for the products, minus the shipping or return costs, which will be borne by the Customer.
- PRODUCT WARRANTY
10.1. All products offered by MOOISH are guaranteed. We commit to replace with a new one or make the corresponding refund if any of your products has a manufacturing defect within 14 days from delivery. In this case, all return expenses and shipping of the new or repaired product are covered by MOOISH.
10.2. The consumer must inform us of the non-conformity of the product within 15 days* from the moment they became aware of it by sending an email stating their desire to return a product. This way, we will arrange the return in the most suitable manner. In the event that the problem with said product is not covered by the warranty, the consumer will be responsible for any additional expenses incurred by the return.

- OBLIGATIONS OF MOOISH AND THE CLIENT
12.1. Mooish undertakes to provide the Client with all necessary information regarding the products it offers, as well as the orders. Mooish shall not be held responsible for the non-performance of these conditions in the event of force majeure or an unforeseeable event, whether by the Client or by a third party unrelated to the contract.
12.2. The Client undertakes to fill in the order forms and their fields according to the instructions provided. Mooish will protect the data in accordance with the law. The Client also undertakes to pay the price of the product, including the corresponding taxes and shipping costs.
12.3. We remind you that it is advisable to keep a copy of the data contained in the purchased products. Mooish shall not be held responsible for any loss of data, files, or, in general, any damage resulting from a failure to back up the data contained in the purchased products by the Client.
12.4. MOOISH is not responsible for the consequences that may result from improper use of the products sold on its Online Store.

All opinions written by Clients are monitored by the marketing team. If the received opinions violate the law, ethics, or morality (abusive advertising, defamation, insults, comments out of context…), MOOISH reserves the right to reject or modify such opinions.

- REGARDING PROMOTIONS AND COUPONS
